BEYONDX AI RECEPTIONIST — SERVICE TERMS

Parties: BeyondX LLC (Washington) and the Client.
1. Service
BeyondX provides an AI receptionist that answers the Client's inbound calls, explains the Client's services and hours, captures caller details, agrees appointment times, issues confirmation codes, and notifies the Client of leads. The assistant discloses at the start of every call that it is an AI and that the call may be recorded. **BeyondX provides no legal, medical or financial advice and guarantees no number of bookings or amount of revenue.**
2. Client responsibilities
The Client supplies accurate services/prices/hours; informs its own callers that calls are recorded where its jurisdiction requires it; and uses the service lawfully (no deception, harassment, unlawful robocalling, or collection of data it has no right to hold).
3. Fees, trial, cancellation
Monthly in advance; 14-day trial; cancel any time, effective at the end of the current period, by email to info@beyondx.llc or the billing portal. No per-minute charges. Unused full months refundable within 7 days of charge; usage is not pro-rated.
4. Data
Call audio, transcripts and structured call data are processed by our subprocessors (Vapi, OpenAI, Soniox, Stripe, Resend; Twilio when enabled). Data is retained for the Client's reporting and deleted within 30 days of cancellation or on request. No data is sold. **Health, financial-account and government-ID details must not be provided to the assistant** (§5 AUP).
5. Acceptable use

6. Availability and remedies
Best-effort 99% monthly availability; the sole remedy is a pro-rated service credit.
7. Liability
Aggregate liability limited to fees paid in the 3 months preceding the claim. No indirect or consequential damages. Neither party limits liability for fraud or intentional misconduct.
8. Indemnity
Each party indemnifies the other for its own unlawful use, content, and breach of these terms.
9. IP
The Client's brand and content remain the Client's. The agent configuration, prompts and platform remain BeyondX's. No resale or white-label without a written agreement.
10. Termination
Either party on 30 days' notice; immediately for unlawful use or non-payment. On termination the assistant and its number are released.
11. Governing law
Washington State law; venue Thurston County, WA. Disputes: negotiation, then mediation, then binding arbitration (individual, not class).
12. Changes to these terms
Terms are versioned. Material changes are emailed to the Client at least 30 days before they apply; continued use after that date is acceptance. The version accepted at checkout is recorded with the Client's subscription.
